Terms of Service

Welcome to ParkShark. These Terms of Service ("Terms") govern your access to and use of the ParkShark mobile application, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. Please read them carefully before using ParkShark.
1. Acceptance of Terms
By creating an account, downloading the app, or otherwise accessing our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access or use our Service.
You must be at least 18 years old to use ParkShark. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
2. Description of Service
ParkShark provides a citizen-powered parking enforcement platform that enables users ("Reporters") to submit reports of parking violations. Key features of our Service include:
- Report Submission: Capture and submit photos of parking violations with GPS location data
- Report Tracking: Monitor the status of your submitted reports in real-time
- Earnings Dashboard: View your accumulated earnings from validated reports
- Payout System: Withdraw your earnings to your registered bank account
All submitted reports are forwarded to authorized parking authorities for review. The decision to issue fines rests solely with these authorities. ParkShark acts as an intermediary and does not directly issue parking fines.
3. User Account and Registration
To use ParkShark's reporting features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access to your account
You may only maintain one active account. Creating multiple accounts to circumvent restrictions or abuse the platform is strictly prohibited and will result in permanent termination.
4. User Responsibilities and Conduct
As a ParkShark Reporter, you agree to:
- Accuracy: Provide accurate and truthful information in all reports
- Authenticity: Only submit reports of genuine parking violations you have personally witnessed
- Integrity: Not submit fraudulent, manipulated, or misleading content
- Privacy Respect: Avoid intentionally photographing individuals (focus on vehicles and violations)
- Legal Compliance: Comply with all applicable local laws and regulations
- Safety: Not put yourself or others at risk while capturing violation evidence
5. Report Submission Guidelines
For a report to be eligible for review by parking authorities, it must meet the following criteria:
- Clear, unobstructed photo showing the violation
- Visible license plate (when safely possible to capture)
- Accurate GPS location matching the photo
- Submitted within 24 hours of witnessing the violation
- No manipulation or editing of photos, timestamps, or location data
Submission of a report does not guarantee that a fine will be issued. Parking authorities have sole discretion over enforcement decisions.
6. Earnings and Payouts
Reporters are eligible to receive 25% of fines collected from their validated reports. Important payout terms:
- Earning Eligibility: Earnings are credited only when the reported fine is actually collected from the vehicle owner
- Payout Schedule: Payouts are processed weekly (every Monday)
- Minimum Threshold: Minimum withdrawal amount is €20 (or equivalent in local currency)
- Payout Method: Direct bank transfer to your registered account (SEPA for EU)
- Processing Time: Allow 3-5 business days for funds to arrive after payout request
Payout amounts may vary based on fine collection rates and timing. We are not responsible for delays caused by parking authorities in fine collection or by banks in processing transfers.
7. Prohibited Conduct
The following activities are strictly prohibited and may result in immediate account termination:
- Fraudulent Reports: Submitting false, staged, or fabricated violation reports
- Data Manipulation: Altering photos, GPS coordinates, or timestamps
- Account Abuse: Creating multiple accounts or sharing account access
- Harassment: Harassing, threatening, or following vehicle owners or parking staff
- Collusion: Coordinating with others to artificially inflate reports
- Illegal Activity: Using the Service for any unlawful purpose
- System Abuse: Attempting to hack, exploit, or disrupt our systems
- Impersonation: Impersonating parking officials or law enforcement
8. Account Suspension and Termination
ParkShark reserves the right to suspend or permanently terminate accounts that:
- Violate these Terms of Service
- Submit fraudulent or manipulated reports
- Have an abnormally high rejection rate indicating bad faith reporting
- Engage in harassment or threatening behavior
- Abuse the platform or attempt to game the system
Upon termination for cause, pending payouts may be forfeited. We will provide notice and opportunity to appeal in cases of suspension, except in cases of clear fraud or illegal activity.
9. Intellectual Property
The ParkShark name, logo, app design, and all related content are owned by ParkShark and protected by intellectual property laws. You may not use our trademarks without written permission.
By submitting reports, you grant ParkShark a non-exclusive, worldwide, royalty-free license to use, store, and share your submitted content with parking authorities for the purpose of violation processing.
10. Limitation of Liability
ParkShark acts as an intermediary platform connecting Reporters with parking authorities. To the maximum extent permitted by law:
- We are not liable for decisions made by parking authorities regarding fine issuance
- We are not responsible for delays in fine collection or payout processing
- We are not liable for disputes between vehicle owners and authorities
- Our total liability is limited to the amount of unpaid earnings owed to you at the time of any dispute
The Service is provided "as is" without warranties of any kind, either express or implied.
11. Dispute Resolution
Any disputes arising from these Terms or use of the Service shall be resolved through:
- Informal Resolution: Contact us first at support@parkshark.io to resolve issues amicably
- Governing Law: These Terms are governed by the laws of Montenegro
- Jurisdiction: Disputes shall be submitted to the courts of Podgorica, Montenegro
12. Changes to Terms
We may update these Terms of Service from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of significant changes through the app or by email.
Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with changes, you should stop using the Service and close your account.
